he court's understanding of how technology works is "pivotal" to Kim Dotcom's extradition case, his lawyer says.
Kim Dotcom has appeared again in court as he fights extradition to the United States over his file sharing website MegaUpload.
Dotcom's lawyer Ron Mansfield began his opening address on Monday, describing to Judge Nevin Dawson how the website worked and the ramifications of the extradition case for the future of the internet.
Mansfield argued it was "politically untenable" that the US used the courts as a "backdoor discussion" and said the US was "attempting to create criminal liability where none exists".
In its short lifetime MegaUpload had one billion unique visitors and at the time accounted for four per cent of the world's internet traffic, the court was told.
The "simple and legitimate" file sharing concept of which Dotcom was the "chief innovation officer", quickly turned into a highly successful business which became the 13th most visited website in the world, Mansfield said.

he should face his accusers and answer to those charges but it should be done on our terms not the usa
we dont need their paramilitary kicking in doors and barking orders a simple extradition request is all thats required

I dont see how anyone has the right to force someone to go to a country he has never been in, to answer charges for alleged crimes that were also not committed in that country, because in the country where the crimes were committed, they are not crimes.

As far as I know...nope.
The alleged offending is only a civil case in Hong Kong, that's probably why he set up there, as criminal sanctions are only applied against physical works such as forged paintings or copied DVD,s... it doesn't cover 1's and zeros on the web.

copyright is not restricted to its country of origin otherwise i would be rewriting Jack Reacher books and publishing them under my own name
nor are patents confined by geography they are the property of the owner until the patent expires
as the world becomes less about geography and more about a global market should we remove the motivation to invent or improve things?
if Bill Gates thought the japanese would just take his work what would be his motivation to even bother developing it
no ownership and rights to replicate, distribute or sell it should be the domain of the owner

The company and Dotcom were based in Hong Kong, and the laws there would make the distribution of files a civil matter. So the aggrieved parties should be undertaking a civil trial in Hong Kong, not a criminal one in the states.. Otherwise, where does it end, me being plucked from my home by the government on behalf of Indonesia, because I was in possession of an ounce of cannabis....and sending me off to face the death penalty?

the hong Kong thing is people using loopholes to cheat the system to negate the laws which in itself is not a crime but where too does that end? will we have companies setting up shop using north korea as their home base?
