On the balance of probabilities or beyond reasonable doubt. How can they be so sure? She never saw his package. She just felt something measuring 4 to 5 inches. His wallet measured 4 inches. That's not beyond reasonable doubt in my view.

Maybe it wasn't so much deviant. More like he got the wrong message from her at some stage and thought that was a good way to answer her.  Maybe I have a different view on it cos I have been on the receiving end of similar behaviour. |

Yes, I certainly have the same view but this case seems to me to have reasonable doubt and is not beyond reasonable doubt . Why did he do it in a council meeting amongst his peers. Why not when they were alone? Her description of the length of what she felt (between 4 or 5 inches) measured the size of his wallet. He never had any prior sexual offences. He didn't ask for name suppression like deviants usually do. Too many doubts for me. |
