Is not a happy chappy Embattled internet mogul Kim Dotcom has been left with two containers filled with rotting furniture after property seized by the US government was returned to him ruined. After a six-year wait, everything from Dotcom's penthouse in Hong Kong frozen by court order in 2011 has arrived in New Zealand. The Hong Kong court ordered his property be returned last year. However, Dotcom has been left far from happy. Just this once I agree with him  |

Considering the USA has no jurisdiction in NZ to extradite him to the USA, I'm glad he won his case. And so he should have.

He's angry. He won't get billions. The parties could possibly settle out of court. The least they can do is give him enough money to go shopping at big save furniture. But yeah, it'll be the taxpayer paying for national govt buck up.

I used to think he was getting a raw deal, but he is just another self serving asshole out to make his own life better, while constantly stealing from others..... hope they just let the US government take him now to be honest.... his extradition has been the slowest one I have ever seen in my lifetime.... hurry it up already, and let him fight his charges..... the rot in a US prison for the rest of the fat fucks life. It was accepted the US was unable to extradite on the charge of copyright violation which meant the conspiracy claims were all plaque.
A finding from the NZ court judge David Harvey said the case would "hang upon the establishment of criminal copyright infringement".
No individual Megaupload defendant is shown to have so criminally copied or distributed a copyrighted work.
There was no legal basis for Megaupload staff being held criminally responsible for a third party copyright violation. "A crime of conspiracy requires an agreement with criminal infringers. No such agreement is shown."
So no "legal"basis for extradition.
The onus is on the USA court system to prove he conspired to copy movies which he did not. He was offering a download service. The end users were the infringers.
It's going to be an interesting case for sure. If, the USA win their case, what's from stopping them from shutting down any ISP providers. Nothing. It's dangerous territory for freedom of use for internet users.

I don't like that the taxpayer is footing the bill. That's not at all fair on us. But you would think that both the USA and NZ justice system heads would have had an airtight charge before they moved to extradite. All those top brains couldn't even prove the onus of guilt because of USA conspiracy copyright laws. It seems silly for them to think Kim wouldnt base his defence on that. |
